Kenya’s government has announced a temporary amnesty for undocumented East African migrants, urging them to formally register at their embassies and extending their stay in the country following last week’s directive to close foreign-owned small businesses.

President William Ruto issued the directive last week, ordering foreign-owned small businesses to shut down by Monday, stating that Kenya “has not built investor confidence for hawkers.” The move sparked panic among many foreigners, particularly Burundians who rely on street vending in Nairobi for their livelihoods.

Crowds queued for hours outside the Burundi embassy, clutching large brown envelopes as they sought travel documents to return home. Suitcases and plastic bags piled up at the compound as many prepared to leave.

In response to the growing unrest, the government issued a statement assuring undocumented migrants that “for the duration of this designated registration period, all individuals undergoing registration will be presumed legally present in the Republic of Kenya.”

Authorities also directed security agencies and local authorities to ensure that foreign nationals are not “subjected to arbitrary harassment or discrimination” during the registration period.

The amnesty appears to have eased fears among East African migrants, though many Burundians had already begun making preparations to leave the country.

A Welcome Diplomatic Shift

President Ruto’s decision to grant amnesty and extend the registration period is a welcome move.

It de-escalates diplomatic tensions with Burundi. It also protects Kenya’s reputation as a regional economic hub.

By guaranteeing legal status during registration, the government has walked back the most controversial aspects of its directive. The move reflects a willingness to listen to regional concerns and correct course.

It is a good step toward balancing national interests with East African solidarity.
